Man arrested for assaulting friend, after he denies him a threesome with his Girlfriend

A man left his friend on his doorstep in a pool of blood for refusing the offer of a threesome made by the victim.

As a neighbor filmed, violence broke out when Iain Connell was kicked out of his house by Craig Stirling, 43, because he was pushing Stirling and his girlfriend for sex.

The witness screamed at Stirling, who, as Dundee Sheriff Court heard, had knocked his friend to the ground for many years before stamping him repeatedly on his back.

She screamed:’ That is Enough.  He’s killing him. He’s murdering him.’

Stirling gasped in horror as the video of his assault was shown in court shortly before Sheriff Alistair Carmichael was imprisoned in Dundee for two years.

As a “Good Samaritan” Mr. Connell had stopped by the couple’s house, offering food and drink in a time of need.

“Iain Connell and the suspects were old friends who had known one another for six or seven years,” Fiscal Deputy Stewart Duncan said.

“When the accused was with his partner, Gillian Smith, 35, they had a chance meeting.

They invited him back to their flat where they drank alcohol.

Mr Connell started behaving against Ms Smith and Mr Stirling in an unacceptable way and was ordered to leave.

“He was screaming out in the street. A witness looked out and started filming. They saw the accused leave the flat block. He approached, and there was a stand-up fight.

They both hurled punches at each other. Mr Connell was repeatedly hit by the accused, causing him to collapse to the ground.

“As he lay on the floor, he kicked him, punched him and continuously stepped on his head.”

The victim was discovered lying in a pool of blood and had a severely broken nose that needed straightening surgery.

Stirling was arrested and told the police: “To me and Gillian, he was making sexual advances. It had been self-defense. It was, frankly, self-defense.”

On September 16, 2020, the Arbroath man confessed to assaulting Connell, causing serious injury and scarring him for life in the town’s West Abbey Lane.

He also confessed that by repeatedly stamping on his head, he pulled him to the ground, beating him on the head and body and leaving him unconscious.

Solicitor Jim Caird, defending, told the court, “He is absolutely stunned and devastated by his conduct. He was the complainant’s good friend.”

“He was actually a True Samaritan. With his partner, Mr Connell had fallen out and had no resources and Mr Stirling and his partner provided food and, unfortunately, drink.

“They took him into their home. There was an unsavory incident in the house and there was a scuffle between them. He was put out of the house.”

Sheriff Carmichael said: “The degree of aggression you displayed here was high. When you kick someone on the ground, you have no control.”

“It is a catastrophe formula and it’s down to chance and not much more that a broken nose was the most serious accident. I take into account that an unsavoury incident happened there.”
